Skyworks Solutions, Inc. and its affiliates (“Skyworks” or “we”) value your privacy. This Skyworks Website Global Privacy Policy (the “Policy”) describes how we collect, store, use, and disclose Personal Information (meaning information that relates to an identified or identifiable person—or, if applicable, as differently defined in the laws where you reside) when you visit and use Skyworks’ website, www.skyworksinc.com, including its subdomain store.skyworksinc.com and any other subdomain, operated by us (the “websites”) or otherwise interact with us, as long as these interactions are not covered by a dedicated privacy notice.

The laws of certain countries or jurisdictions require us to provide you with additional information about our processing activities.  Please refer to the relevant Section at the end of this policy for supplemental information specific to your jurisdiction, as applicable.

California Notice at Collection:  Skyworks collects the categories of Personal Information identified in Section 11(a) for the purposes identified in Section 3, and retains Personal Information for the period described in Section 7 below.  We do not sell your Personal Information or disclose it to third parties for cross-context behavioral advertising.  We also do not collect or process sensitive Personal Information for the purpose of inferring characteristics about you.

1. What is the scope of this Policy?

This Policy applies to Personal Information that we collect through our websites or third parties, or when you otherwise interact with us. It does not apply to websites owned and/or operated by third parties, regardless of whether our websites link to or have advertisements for them.

Skyworks does not provide products or services to individuals for personal or household use or collect Personal Information from individuals in their capacity as consumers. You may not use our websites or services in your capacity as consumer.  

2. What types of information do we collect and how do we collect it?

Below is a list of the categories of Personal Information we collect, as well as the means by which we collect them:

Information you provide. We may collect Personal Information about you when, for example, you register for Skyworks’ eNewsletter service, contact us or request more information, participate in a live webcast, create an account or edit its information, order a product or service, use our order status or shipment status services, use our product return services, submit an application or resume to us for employment, initiate or participate in a live chat on the websites, complete a survey or otherwise provide feedback. Such information might include your name, mailing address, telephone number, e-mail address, account number, company payment or account information, product or service details, job title and business, company name, and other identification and contact information.

Information we collect from our websites or third parties. We may also collect certain information about you when you visit our websites via cookies and similar technologies. If you access our websites via a link from a different website, for example, we may collect the URL of that website. Similarly, if you access a different website via a link from our websites, we may collect the URL of that website as well. We may additionally collect information about your operating system, your browser type, your IP address, the general area in which your server is located, and the type of the mobile device you use to access our websites. We and our vendors further collect information concerning how you use our websites, including when you visit them, how much time you spend viewing them, the parts that you visit, the search terms that you enter, transaction data, and other click-stream data. If you download materials from our websites, we may also collect information about those files.

We may also collect Personal Information from other categories of sources including:

  • Service providers, for example, analytics providers, IT, and system administration services.
  • Marketing/advertising companies.
  • Recording technologies installed by Skyworks, for example, voicemail technologies and audio recording technologies with consent to the extent required by law.

We may also collect certain information that you provide to third parties (including contact and clicking information), such as when you click on one of our ads in an email from another company.

3. Why do we collect Personal Information?

Our primary goal in collecting Personal Information is to provide our visitors with superior service and a customized online experience. We collect and process the Personal Information for the following purposes:

  • Providing you with the information, products, and services you request, including participating in webcasts, requesting support or assistance, placing orders, confirming the details and statuses of your orders, and making returns;
  • Allowing you to establish, maintain and edit your account;
  • Allowing you to participate in surveys;
  • Administering our systems and improving our services, including by diagnosing problems with our servers and software and protecting the security of our systems and customer information;
  • Analyzing websites’ visitor behavior to measure visitors' relative interest in the various parts of our websites, enhance visitors' experiences, customize the content and layout of our websites, and develop new products and services;
  • Providing you with information and advertisements concerning our product or service offerings, as well as transactional or other communications, by email, online and mobile advertising, including personalizing advertisements across website and mobile applications or analyzing or measuring advertisements based on information associated with your device;
  • Administering the careers portion of our websites and processing your job application;
  • To protect the rights, property, or safety of Skyworks, you, or others;
  • To report suspected criminal conduct to law enforcement and cooperate in investigations;
  • To exercise our rights under applicable law and to support any claim, defense, or declaration in a case or before a jurisdictional and/or administrative authority, arbitration, or mediation panel;
  • To ensure compliance with applicable laws and regulatory obligations; and
  • All other uses we otherwise describe in this Policy or elsewhere when we collect the Personal Information.

To the extent permitted under applicable law, we may combine Personal Information we collect from different sources to achieve these purposes.

4. To whom do we disclose Personal Information?

We may disclose your Personal Information to third-party vendors, service providers or distributors to provide you with products and services that you request. We may also provide them with Personal Information when they work on our behalf and need access to your Personal Information to carry out their work for us. This includes third-party service providers used for carrying out surveys and to maintain a live chat functionality on our websites. We may also provide anonymized information and aggregated statistics concerning our websites’ traffic and other website-related information to third parties. We may additionally disclose your Personal Information with third parties based on your consent.

To the extent these third parties qualify as so-called “processors” under the GDPR or other applicable law, or as applicable law otherwise requires, we will enter into the required contracts with such third parties.

We may disclose Personal Information, as required by and subject to applicable law, to cooperate with an investigation or to respond to requests/ orders by competent authorities, or to protect or exercise our or others’ legal rights (including during court proceedings). We may also disclose Personal Information in cases of emergency, to protect others’ safety, or to report to law enforcement and government agencies any activities that we in good faith believe to be unlawful.

We may also disclose Personal Information with our affiliates, our subsidiaries, or third parties in connection with an actual or potential merger, sale, or other similar transaction between us and another entity, to the extent permitted by applicable law.

We do not sell, trade, or lease your Personal Information to others.

5. What are the legal bases for the collection and processing?

We use different legal bases to process your Personal Information in accordance with the applicable law. When you provide us with Personal Information to obtain products, services, or information you requested, establish and maintain your account, confirm the details and status of your orders, and make returns, the legal basis for the processing is the performance of contract. We administer the careers portion of our websites and process your job application to take steps at your request to enter into a contract with you or for our legitimate interests. We also process your Personal Information based on legitimate interests to administer our systems and improve our services.  Where required by applicable law, we will also request your consent prior to collecting and processing your Personal Information. When we use certain types of cookies or similar technologies that are not strictly necessary, in the sense that they are not technically required for you to access our websites and to provide you with functionalities you have explicitly requested, we ask you for your consent. We also ask for your consent when we want to provide you with information and advertisements concerning our product or service offerings, unless in certain jurisdictions sending such information and advertisements is permitted on the basis of giving you the possibility to opt-out. 6. What are your choices regarding Personal Information?

You may access and edit the Personal Information that you have provided to us. At any time, for example, you may change the Personal Information listed in your account online.

Also, depending on where you live, you may have the following rights described below concerning your Personal Information, which you may exercise free of charge, though we have the right to charge a reasonable fee in some circumstances:

  • To object to our processing of your Personal Information;

as well as following rights:

  • To request access to your Personal Information;
  • To request rectification of any inaccuracies in your Personal Information and completion of incomplete Personal Information;
  • To request erasure of such Personal Information as applicable;
  • To obtain a restriction of our processing of your Personal Information;
  • To receive your Personal Information in a structured, commonly used and machine-readable format and request that your Personal Information be transferred to you or a new provider; and
  • To withdraw your consent at any time to the collection and processing of Personal Information by us or by vendors on behalf of us, as discussed below (without affecting the lawfulness of any collection, use, and processing based on consent before its withdrawal).

In case that we do not act on your request or if you otherwise consider that our processing of your Personal Information infringes applicable law, you also have the right to lodge a complaint with a competent supervisory authority. Based on your consent (or legitimate interests where permitted) we may from time to time send you e-mail or other communications regarding current promotions, specials, and new additions to our websites. You may “opt out” or unsubscribe from our newsletters also by following the unsubscribe instructions in any such communication you receive from us. After doing so, you will not receive future marketing communications or mailings unless you “opt in” again or register for a new account. Note that we may still send you non-marketing emails related to your account or transactions.

We may also send you news alert emails if you choose to request them, unless you separately unsubscribe from those alerts by clicking the unsubscribe link at the bottom of the emails or sending a request to webworks@skyworksinc.com.

We may use third-party services to provide you with personalized advertising if you consent to the use of advertising cookies. This may include using cookies to show you advertisements based on information about your interests or based on your previous web browsing history. To opt out of the personalization of advertisements, you can visit Google’s Ads Settings, optout.networkadvertising.org, or http://optout.aboutads.info, or https://www.youronlinechoices.com/ or visiting our Privacy Preference Center to administer your cookies choices. Opting out does not mean you will block online advertising altogether or see fewer ads. It simply means that the advertising that you see will not be personalized for you. If you decide not to share certain Personal Information with us, then we may not be able to provide, for example, the corresponding information or service requested. 7. How long is your Personal Information retained?

We retain Personal Information for as long as needed to fulfill the purposes for which it was collected, taking into account the applicable limitation periods, and will delete it without undue delay afterwards. We will undertake appropriate measures to delete documents containing Personal Information (for example, electronic documents will be deleted in an irreversible matter and all physical copies of documents will be shredded).

We will, however, retain and use Personal Information after this timeframe as needed to resolve any disputes, and satisfy any legal, accounting, or reporting requirements.

8. Where is Personal Information stored and transferred?

Subject to your permission or as permitted by law, we may transfer your Personal Information within Skyworks and to third-party vendors or service providers across state and country borders.

If we transfer Personal Information from the EEA or the UK to other (third) countries, including countries that have not been determined by the European Commission to have an adequate level of data protection (a list of the Skyworks entities and third-party recipients located outside the EEA and UK is available here), we use appropriate safeguards and legal mechanisms to effectuate the transfer. Transfers to third countries outside the EEA or the UK, for which there is no adequacy decision, will usually be based on the so-called Standard Contractual Clauses including where necessary the Information Commissioner’s Office (ICO) International Data Transfer Addendum to the EU Commission Standard Contractual Clauses (“UK Addendum”) or the UK International Data Transfer Agreement (“IDTA”) respectively (together, “SCCs”). Depending on whether the recipient outside the EEA or the UK is acting as a so-called “controller” or “processor,” the respective set of SCCs will be used. We may also exceptionally base transfers to recipients outside the EEA or the UK on the derogations listed in Article 49 of the GDPR or UK GDPR. These include explicit consent, the necessity of the transfer for the performance of a contract between the respective individual and us, or if the transfer is necessary for the establishment, exercise or defense of legal claims.

Specifically with regard to Personal Information collected via cookies, please note that in some cases cookie information may also be processed by our service providers or by the providers of third-party cookies in countries outside the EEA and/or UK that do not offer a level of data protection comparable to the EEA and UK (as applicable). In some countries, such as the USA, there is a particular risk that local authorities may obtain access to cookie information for monitoring purposes and there may be no effective legal remedies against such access. To the extent that you have given your consent to the use of cookies, you also consent to the transfer and further processing of Personal Information collected via cookies to countries outside the EEA and the UK. The transfer is also usually additionally secured by the conclusion of SCCs.

References in this Policy to GDPR shall be read, where UK GDPR is applicable, as references to the equivalent provision of UK GDPR.

9. What about children’s privacy?

We neither intentionally nor knowingly collect Personal Information concerning children as defined by applicable law. Our websites is not directed to children. We request that children do not provide us any such information. If you believe we may have collected such information, please notify us and we will take prompt and appropriate measures to investigate and resolve the issue.

10. Security

We take security of your Personal Information seriously and have implemented necessary and appropriate security measures to prevent leakage, loss, or damage to your Personal Information. Below is a summary of some of the security measures we have implemented:

Information Security Program

Maintain a comprehensive Information Security Program that includes various physical, administrative, and technical safeguards to protect personal data. These measures are designed to ensure:

  • security, confidentiality, and integrity of personal data;
  • risk-based approach to the protection of critical resources and personal data; and
  • processing of the data aligns with our privacy practices

Data Protection

Develop processes and technical controls to identify, classify, securely handle, retain, and dispose of data. This includes processes and tools used to prevent data exfiltration, mitigate the effects of exfiltrated data, and ensure the confidentiality and integrity of personal data

Secure System Configuration

Establish, implement, and maintain secure configurations of enterprise assets (network devices, servers, databases, and user endpoints) to prevent attackers from exploiting vulnerable services and settings

Account and Access Management

Use processes and tools to create, assign, manage, and revoke access credentials and privileges for user, administrator, and service accounts for Skyworks systems according to the principles of least privileges and need to know

Controlled Use of Administrative Privileges

Maintain processes and tools to track, control and restrict the use, assignment, and configuration of administrative privileges on computers, networks, applications, and data

Continuous Vulnerability Management

Continuously acquire, assess, and act on new information to identify vulnerabilities, remediate, and minimize the window of opportunity for attackers

Audit Log Management

Collect, manage, and analyze audit and security logs of events that could help prevent, detect, or recover from a possible attack

Email Protections

Deploy automated controls to minimize the attack surface and the opportunities for attackers to manipulate human behavior through their interaction with email systems

Malware Defenses

 

Install and configure software that prevents or restricts the installation, spread, and execution of malicious code at multiple points in the enterprise

Data Recovery

Establish and maintain data recovery practices sufficient to restore in-scope enterprise assets to a pre-incident and trusted state

Network Security Infrastructure

Actively manage network devices; Operate processes and tools to monitor and defend against security threats across the enterprise’s network infrastructure and user base

Wireless Access Control

Control, prevent, and correct the secure use of wireless local area networks (WLANs), access points, and wireless Customer systems

Security Awareness

Employ a security awareness program to influence behavior among the workforce to be security conscious and properly skilled to reduce cybersecurity risks to the enterprise

Service Provider Management

Develop a process to evaluate service providers who hold sensitive data, or are responsible for an enterprise’s critical IT platforms or processes, to ensure these providers are protecting those platforms and data appropriately

Application Security

Manage the security life cycle of in-house developed, hosted, or acquired software to prevent, detect, and remediate security weaknesses before they can impact the enterprise

Incident Response

Establish an incident management program to prepare, detect, and quickly respond to an attack

Security Assessments

Performing security assessments to test the overall strength of the organization’s defense (the technology, processes, and people) and validate the effectiveness of the controls, policies, and procedures of the organization’s privacy and personal data protections

11. Additional Information for California Residents

a. Categories of Personal Information We Collect

Skyworks may have collected the following categories of Personal Information of California residents in the past 12 months:

 

  • Identifiers such as a real name, mailing address, telephone number, Internet Protocol address, email address, or account number;
  • Personal information described in subdivision (e) of California Civil Code Section 1798.80(opens in a new tab), such as a signature;
  • Commercial information, including records of products or services purchased on behalf of your company;
  • Internet or other electronic network activity information, including browsing history, search history, and information regarding your interaction with our website, application, or advertisement; and
  • Professional or employment-related information, including job title or business affiliation.

 

This Personal Information is collected and used for the purposes disclosed in this Privacy Policy.

To the extent that we collect sensitive Personal Information, we do not infer characteristics from this information.  We only use sensitive Personal Information as necessary to perform the services or provide the goods the average person would reasonably expect when requesting those goods or services, to ensure security and integrity, short term transient use, to maintain the quality of our products and services, or for other purposes permitted by the California Privacy Rights Act and implementing regulations (“CPRA”) without the right to opt out.

Note that we may aggregate and/or deidentify information, use it internally, and disclose to third parties.  Neither Aggregated Information nor Deidentified Information (defined below) is Personal Information.

 

  • “Aggregated Information” refers to information about a group of individuals from which the individually identifiable information has been removed. An example of Aggregated Information would be the statistic that 20 people used our website’s contact form on a given day.
  • "Deidentified Information” means information subjected to reasonable measures to ensure that the deidentified information cannot be associated with the individual. An example of Deidentified Information would be the data point that an unidentified visitor first entered the website through our main web page. We maintain Deidentified Information in a deidentified form and do not attempt to reidentify it, except that we may attempt to reidentify the information just to determine whether our deidentification processes function correctly.

 

b. Disclosures of Personal Information

Skyworks does not sell or “share” Personal Information (where “share” means disclosing to third parties for cross-context behavioral advertising).  Moreover, Skyworks has not, and has no actual knowledge that it has, sold or “shared” the Personal Information of any individual in the past 12 months, including the Personal Information of children under the age of 16.

In the last 12 months, Skyworks has disclosed each of the categories of Personal Information in Section 2, above, for “business purposes,” as that term is defined under the CPRA, as follows:

 

  • Service providers: For the business purpose of performing services on Skyworks’ behalf and, in particular, for the specific purposes described in section 3 above.
  • Auditors, lawyers, consultants, and accountants we engage: For the business purpose of auditing compliance with policies and applicable laws, in addition to performing services on Skyworks’ behalf.
  • Affiliated companies: To other companies within the Skyworks family of companies for the business purposes of (1) auditing compliance with policies and applicable laws, (2) helping to ensure security and integrity, (3) debugging, (4) short-term transient use, (5) performing services on behalf of Skyworks, (6) internal research, and (7) activities to maintain or improve the quality or safety of a service or device.

 

c. Your California Privacy Rights

Subject to applicable law, California residents have the following rights:

 

  • Right to Know: You have the right to submit a verifiable request for specific pieces of your Personal Information obtained from you and for information about Skyworks’ collection, use, and disclosure of your Personal Information.
  • Right to Delete: You have the right to submit a verifiable request for the deletion of Personal Information you have provided to Skyworks.
  • Right to Correct: You have the right to submit a verifiable request for the correction of inaccurate Personal Information maintained by Skyworks, taking into account the nature of the Personal Information and the purposes of processing the Personal Information.

e. How We Will Verify Your Request

To verify your identity, Skyworks generally will match information you provide with information that Skyworks already maintains. Such information may include, for example, your name, telephone number, mailing address, email address, or other information, depending on the context of your interactions with the company. The more risk entailed by the request (i.e., a request for specific pieces of Personal Information), the more items of Personal Information we may request to verify you. If Skyworks cannot sufficiently verify your identity with the information you provide in your initial request, Skyworks may follow up and request any necessary additional information.

f. Authorized Agents

If you want to submit a request via an authorized agent, you may do so by providing the agent with a valid power of attorney. If the agent does not have a valid power of attorney, you must give the agent signed permission to submit the request, verify your identity directly with Skyworks, and confirm directly to Skyworks that you have provided the agent with such permission. Skyworks may contact you after receiving a request from a purported agent.

g. Skyworks’ Non-Discrimination Policy

Skyworks will not discriminate against you for exercising any of your rights under California privacy law.

12. Additional Information for India Residents

By using our website, you hereby indicate that you have the capacity to enter into a legally binding contract either by yourself or as a legal guardian and have read and understood all the terms set out in this Policy.

You expressly provide consent for transfer of your Personal Information to areas outside of India. You have the right to withdraw your consent at any point in time. In most cases, upon such a withdrawal, we may not be able to continue offering our products and services to you.
